1. Data Controller
The data controller for the Hemiola application and related services is Gianluca Barbaro ("we", "us", "our"), contactable at info@barbaro.it.
2. Data We Collect
We collect only the minimum data necessary to provide our services:
- Account data — email address, display name, and optional profile photo when you create a Cloud account.
- Device identifiers — a locally generated UUID used to associate devices with your account for backup and sync purposes.
- Settings & presets — when you enable Cloud Backup, your app settings and presets are stored on our servers in encrypted form.
- Usage analytics — anonymous, aggregated statistics such as app version, platform, and crash reports. No personal data is included.
- Device telemetry — if you opt in via Settings → Privacy, we collect anonymous technical data about the MIDI hardware you connect: the product model name reported by your operating system (e.g. "EWI Solo", "KeyStep Pro"), connection type (BLE, USB, or network), firmware version when available, app platform, and approximate region (country code from your device locale). A pseudonymised identifier derived from your account and device IDs via a one-way hash is stored solely to enable GDPR deletion; it cannot be reversed to identify you. This data is structurally separated from your account and is never linked to your name or email address.
3. Purpose & Legal Basis
We process your data based on:
- Contract performance (Art. 6(1)(b) GDPR) — to provide the service you signed up for (account management, backup, sync).
- Legitimate interest (Art. 6(1)(f) GDPR) — to improve app stability and user experience through anonymous analytics.
- Consent (Art. 6(1)(a) GDPR) — for optional features such as push notifications, community preset sharing, and device telemetry (opt-in only, disabled by default, adjustable at any time in Settings → Privacy).
4. Data Sharing & Third Parties
We do not sell your personal data. Data may be shared with the following categories of processors, all of which are bound by data processing agreements:
- Cloud hosting providers (EU-based servers)
- Analytics services (anonymous, aggregated data only)
- Payment processors for subscription management (Apple, Google, Microsoft, RevenueCat)
5. International Transfers
Your data is stored on servers within the European Economic Area (EEA). If any processing occurs outside the EEA, we ensure appropriate safeguards are in place (e.g., Standard Contractual Clauses).
6. Data Retention
Account data is retained for the duration of your account plus 30 days after deletion. Backup data is deleted immediately when you delete a device or your account. Cloud subscription data (presets, settings, backups) is retained for 90 days after a Cloud Pro subscription ends or is cancelled; after this period, data is permanently deleted unless you resubscribe. Anonymous analytics and device telemetry data are retained for up to 24 months. All telemetry records associated with your account are permanently deleted when you delete your account or withdraw telemetry consent.
7. Cookies & Local Storage
The Hemiola app does not use cookies. The companion website uses only essential, non-tracking cookies for session management. No third-party tracking cookies are used.
8. Your Rights
Under the General Data Protection Regulation (GDPR), you have the right to:
- Access the personal data we hold about you
- Rectify inaccurate or incomplete data
- Erase your data ("right to be forgotten")
- Restrict or object to processing
- Data portability — receive your data in a structured, machine-readable format
- Withdraw consent at any time without affecting prior lawfulness
- Lodge a complaint with your national Data Protection Authority
To exercise any of these rights, contact us at info@barbaro.it. We will respond within 30 days. To withdraw device telemetry consent at any time, go to Settings → Privacy in the app — no contact required.
9. Security
We implement appropriate technical and organisational measures to protect your data, including encryption in transit (TLS) and at rest, access controls, and regular security reviews.
10. Children
Hemiola is not directed at children under 13. We do not knowingly collect data from children. If you believe a child has provided us with personal data, please contact us and we will delete it promptly. By using the app, you confirm that you are at least 13 years of age.
11. Changes to This Policy
We may update this policy from time to time. Material changes will be communicated through the app or via email. The "Last updated" date at the top reflects the most recent revision.

1. Acceptance
By downloading, installing, or using the Hemiola application, you agree to these Terms of Service and our Privacy Policy.
2. License
We grant you a personal, non-exclusive, non-transferable, revocable licence to use Hemiola on devices you own or control, subject to these terms. The app is available in three tiers — Free, App Pro, and Cloud Pro — each with different features. The current feature list for each tier is available at hemiola.app.
3. Subscriptions & Purchases
In-app purchases and subscriptions are processed by the respective platform stores (Apple App Store, Google Play, Microsoft Store). Refund policies are governed by the store terms. Cloud subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
Cloud Pro Lifetime grants access to Cloud Pro features for the entire lifetime of the Hemiola Cloud service, with a guaranteed minimum period of 24 months from the date of purchase. Should the service be discontinued, you will receive: (i) at least 12 months' advance notice; (ii) tools to fully export your data; and (iii) for purchases made less than 24 months prior, a refund proportional to the unexpired portion of the guarantee period. The app and all non-cloud features remain fully usable even after any discontinuation of the service.
Purchases made through the Hemiola website are processed by Paddle.com Market Limited ("Paddle"), our authorized reseller and Merchant of Record. Paddle handles billing, invoicing, payment, and applicable taxes for web purchases, and is the contracting party for those transactions. Refunds for web purchases are governed by our Refund Policy.
4. User Content
You retain ownership of presets and configurations you create. By publishing presets to the Community Library, you grant us a non-exclusive, worldwide, royalty-free licence to distribute them within the Hemiola platform. If you delete your account, presets you have published to the Community Library remain available and are attributed to "Anonymous".
Your username, profile picture, preset names, and any other content you make publicly visible must not include, promote, or link to: (a) material that is illegal, defamatory, obscene, pornographic, hateful, or that incites violence or discrimination; (b) content that infringes the intellectual property rights of third parties; or (c) commercial advertising for products or services that directly compete with Hemiola. We reserve the right to remove non-compliant content and to suspend or terminate accounts that violate these standards.
5. Prohibited Use
You may not reverse-engineer, decompile, or disassemble the application; use it for unlawful purposes; attempt to gain unauthorised access to our servers; or distribute malicious content through the Community Library.
6. Disclaimer
Hemiola is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free operation. The app is not designed or warranted for use in safety-critical environments; we make no representations regarding audio latency, round-trip performance, or suitability for professional live performance. To the maximum extent permitted by applicable law, our liability is limited to the amount you paid for your subscription in the 12 months preceding the claim (or €0 for free users).
7. Governing Law
These terms are governed by the laws of Italy and the European Union. Any disputes shall be resolved in the courts of Milan, Italy, without prejudice to mandatory consumer protection provisions of your country of residence.
8. Intellectual Property
The Hemiola application — including its source code, interface, audio engine, soundfonts, brand name, and all related content — is the intellectual property of Gianluca Barbaro and is protected by Italian and international copyright law. Nothing in these Terms grants you ownership of or rights in any of our intellectual property beyond the licence expressly granted in §2.
9. Termination
We reserve the right to suspend or terminate your access to Hemiola, with or without notice, if you breach these Terms or if we reasonably believe continued access poses a risk. Upon termination, your licence to use the app ceases immediately. Sections 4, 6, 7, and 8 survive termination.
10. Updates to These Terms
We may update these Terms at any time. For material changes we will provide at least 14 days' advance notice via in-app notification or email, and — where legally required — obtain your renewed consent before the changes take effect. The date of the most recent revision appears at the top of this page.
